The copyright in all photographic works resulting from the booking remains the property of Say Cheese.

 

The Act

Say Cheese and the client agree they will abide by the standard terms in section21(3) of the Copyright Act 1994. Specifically, the client agrees not to copy any physical or digital image without the consent of Say Cheese.

 

Errors

Say Cheese takes no responsibility for names spelt wrong or any other error provided by the client.

 

Additions

Any additions to our standard photo setup will be charged at an hourly rate of $100 + GST or part thereof. This includes additions to the photo set up ie. additional logos, Performance tally (points for and against), photo inserts etc. This also applies to any major photoshop work required.

 

Promotion

The client agrees that Say Cheese may use the client’s images in promotion and advertising of the Say Cheese web site.

 

Compensation

The client undertakes to compensate Say Cheese for any loss or damage, incurred as a result of any breach conditions, including damage to Say Cheese property and or equipment while on the client’s property.

 

Cancellation

Termination of the photoshoot by the client must be in writing and be received 48 hours before the arranged time and date.

 

Prior Notice

Where the client cancels or postpones a booking appointment without contacting Say Cheese, the Client must pay a fee to cover Say Cheese photographer for time and travel expenses.

 

Permission

The client agrees to have written permission from all members involved in a photoshoot, especially from parents of children to be photographed.

 

Attendance

It is the responsibility of the client to ensure all members of the group are present at the photoshoot. No insertions of absent people will be added (without our standard design fee). Only one visit is permitted under the “Free” photo shoot terms, any further visits in the same year will be charged. We only provide free photoshoots for teams or organisations with 5 or more teams/groups.

 

Discolouration

The Client acknowledges that photographic works may fade or discolour over time due to the inherent qualities of materials used and UV light. The client releases Say Cheese from any claim based upon fading or discolouration.

 

Force of Nature

Neither the Client nor Say Cheese shall be liable for any loss or damage arising directly or indirectly due to an act of God, fire, armed conflict, labour disputes, civil commotion, intervention of a government, accidents, interruption to transportation, weather or any other cause outside Say Cheese control.

 

Consumer Guarantees Act 1993

Will apply to the licensed Photographic Works provided by Say Cheese if the client acquires those licensed photographic works for personal, domestic or household use or consumption.

 

Liability

Say Cheese liability to the client for any costs, loss or damage suffered by the client, arising out of the performance or failure of performance of Say Cheese shall not exceed the full value of the payments made by the client under the order agreements.
